 MESSAGE FROM PRESIDENT KATHLEEN A. CAVANAUGH

As I write to all of you this month, I am reflective of the loss our community felt with the passing of Judge William Boyle. Judge Boyle was a friend to many, including the Hampden County Bar Association.   He strongly supported the Hampden Count Bar Association by spending his time attending many of our events such as Race Judicata- a Run for the Bar, Toast to the Season, the annual Judicial Dinners, and Annual Meetings as well as evening socials. He also participated on our Bench/Bar Committee and was always trying to find ways to make the bar a better place for practicing attorneys. Judge Boyle was very approachable, kind, and of course, always willing to share a joke. His presence in Courtroom One of the Hall of Justice will truly be missed. Judge William Boyle was the epitome of fellowship.  I have reflected many times since attending the Services about our community and what we can do to continue to foster fellowship amongst ourselves and aspire to live by Judge Boyle’s example.  While at Judge Boyle’s Mass, which was attended by many from our community, I could not help but have the feeling of how strong and yet how venerable our community is. We work in a profession that is fast past based on immediate access to knowledge through the internet. Interaction with clients, associates, fellow attorneys, staff, etc. is quickly becoming less personable due to emailing and texting. Society often blames lack of socialization of our youth on the fact that they play too many video games, however, are we not doing the same by emailing and texting instead of picking up the phone or having a chat with someone over a cup of coffee? I firmly believe that fellowship is an essential part of an Attorney’s wellbeing. We oftentimes keep ourselves in our office and at our computers working. I myself, have a habit of sacrificing time with others in an effort to stay focused on my work that needs to be done. The Hampden County Bar Association recognizes the importance of fellowship and offers many opportunities to get and keep our community connected through annual events, social events, seminars, and volunteer opportunities.  We hope that you will find something you enjoy and foster fellowship with your community.  I will end by using the quote that ended the eulogy at Judge Boyle’s Mass, “Spend your life living.” 

 
I would also like to take this opportunity to let you know that our Administrative Assistant and House Photographer Lynne McMillan’s last day in the office is today, October 4, 2019.  I want to thank Lynne for her seven-plus years working at the Hampden County Bar Association. Among other things, she has done a great job capturing the fun through the lens of her camera. I wish Lynne all the best in her new endeavors. 
 
ATTORNEY WELLBEING TIP: Fellowship – try to spend a few minutes each week looking at the HCBA’s website for upcoming events and socials; select which one you will attend and put it in your calendar. Ask around to your colleagues and encourage others to join you.  At least once a week, take a break and chat with a colleague. The HCBA offers inexpensive coffee and room to sit and chat for 5-10 minutes during the breaks. Another idea, offer to walk with someone to the parking garage; it’s a great time to have a chat. The key to success is through relationship building. I wish you all the success in the world.

As a reminder, the HCBA has installed a copier in the Westfield District Courthouse, 224 Elm Street, Westfield, MA for the convenience of our members.  All HCBA members can access the Westfield copier using their Springfield copy codes. Please donate paper for the copier if you can! If you cannot access the Westfield copier or you are experiencing difficulty, please contact Caitlin at the HCBA office.

 PRO BONO ATTORNEY OF THE MONTH

This Month we would like to recognize Attorney Ann E. Dargie from the Law Offices of Jennifer A. Thorn, P.C. as our Pro Bono Volunteer for September.  Attorney Dargie makes it a practice to volunteer as Probate and Family Court Lawyer for the Day program throughout the year.  Thank you, for your continued commitment to volunteering and giving back to your community!  The Hampden County Bar Association Legal Clinic acknowledges attorneys who consistently make time for pro bono work by volunteering for our LFD and conciliation programs on a regular basis.  The "Pro Bono Volunteer of the Month" will be entitled to one free brown bag lunch seminar and recognized each month in the Barrister Newsletter...will you be the next one??

6th Annual Race Judicata Follow-Up

September 29th was an excellent day for the 6th Annual Race Judicata - A Run for the Bar.  We had a perfect day for our awesome runners and walkers of all ages, including the Kids Fun Run.  Without all of our participants, sponsors, committee members and volunteers including those from Baystate Academy Charter Public High School, it would not have been such a huge success!  The proceeds from this year's event benefit the Children's Law Project, which provides an attorney to children in need of legal representation in the Hampden County Probate and Family Court, and the Colonel Archer B. Battista Veterans Scholarship Fund.  We are pleased that so many members of our bench, bar, and community came out to participate in such a worthy cause.

Volunteer Opportunities in District Court

District Court Lawyer for the Day

Thanks to our incredible volunteers, our District Court Lawyer for the Day (LFD) program served an impressive 52 clients in September. The District Court LFD program is a great opportunity to provide brief legal advice to self-represented litigants. Among other things, volunteer lawyers can help a client understand how to better navigate the court process, prepare a client for court, complete forms with a client, or advise a client that a case is not actionable.

Consumer Debt Initiative

The Consumer Debt Initiative (CDI) is a new pro bono opportunity operating in the District Court this spring, thanks to a generous grant from the MassMutual Foundation. The CDI aims to holistically address the often debilitating economic and legal consequences of being in financial debt. The Legal Clinic has developed a Lawyer for the Day program to represent collection action defendants in the small claims session of the District Court on a weekly basis. It will also partner with other organizations to address the high rate of default in these lawsuits, and empower consumers and their families by connecting them to educational materials and other financial literacy resources in our community.  Interested volunteers should contact the legal clinic by email or by calling 413-733-6500. 

CDI program served an impressive 32 clients in September.  In addition, we saved clients a total of $27,481.25.

Consumer Debt Initative (CDI) Training

The HCLC will be holding a FREE Consumer Debt Initiative (CDI) Training on Friday, October 25, 2019, from 12:45 pm to 2:15 pm, in the Roderick L. Ireland Courthouse Commissioners Room. The CDI serves self-represented litigants who are defending credit card collection actions that are filed by debt buyers in the Springfield District Court Small Claims session. Volunteer lawyers provide counsel and legal advice, negotiate with opposing counsel, draft settlement agreements, and may appear on behalf of consumers for hearings and trials. Landlord-Tenant Lawyer for the Day

Thanks to our amazing volunteers, our Landlord-Tenant Lawyer for the Day (LFD) served 21 clients in September.  This program serves self-represented litigants with matters that fall within the jurisdiction of the Housing Court. Volunteer lawyers provide brief legal advice to landlords and tenants about the preparation of notices to quit, complaints, and responsive pleadings in eviction cases so to be prepared for their day in Housing Court.

Western Division Housing Court Lawyer for the Day

Thanks to our fabulous volunteers, our Western Division Housing Court LFD program served an incredible 86 clients in September. The Hampden County Bar Association Arbitration & Mediation Service maintains a roster of highly qualified lawyers and retired judges for arbitration, mediation, or case evaluations.  Our panel members, as an accommodation to the Bar Association, have agreed to serve at substantially reduced rates for arbitrations, mediations or case evaluations. Indeed, many of our panel members independently mediate and arbitrate cases at higher rates. Why not conserve resources by coordinating your arbitrations or mediations through the Hampden County Bar Association? We encourage you to support your bar association by keeping the Arbitration and Mediation Service in mind for alternative dispute resolution.  LAWYER REFERRAL & INFORMATION SERVICE

Do you know the Hampden County Bar Association’s Lawyer Referral & Information Service (LRIS) is the only American Bar Association (ABA) accredited referral program in Massachusetts? This approval allows us to use the ABA’s Logo, which gives us access to improved marketing materials allowing us to expand our program thereby increasing the number of referrals to you.

As a participant of the LRIS program, you join a panel of experienced lawyers, and you agree to make yourself available to members of the community who are in need of legal assistance on a referral basis. Please note that each individual referred to you will have indicated that they can pay for an attorney. You agree to charge only $25.00 for your first half hour consultation, but after that your regular office rates apply. In exchange for the referral, the HCBA requires only 15% of the total fee, if over $100.00, when the case is resolved to meet our LRIS operating expenses.

As an added benefit, panel attorneys are invited to participate on a Reduced Rate Panel at no additional charge. By accepting reduced fee referrals, attorneys agree to charge a fee of no more than $75.00 per hour. The standard 15% referral fee is not required on reduced fee matters.  

So far into 2019, panel attorneys have already submitted over $81,982 in LRIS referral percentage payments, as a result of over $546,546 in client fees.

The Legal Clinic is a pro bono program of the Hampden County Bar Association which strives to continually improve access to justice for the underserved in Hampden County through volunteer efforts of legal professionals. The Legal Clinicprovides free essential legal and law-related services to area residents in need through a variety of pro bono initiatives and community-based programs. There are no income restrictions or other limitations on participation in our programs.

Consumer Debt Initative (CDI) Training

The HCLC will be holding a FREE Consumer Debt Initiative (CDI) Training on Friday, October 25, 2019, from 12:45 pm to 2:15 pm, in the Roderick L. Ireland Courthouse Commissioners Room. The CDI serves self-represented litigants who are defending credit card collection actions that are filed by debt buyers in the Springfield District Court Small Claims session. Volunteer lawyers provide counsel and legal advice, negotiate with opposing counsel, draft settlement agreements, and may appear on behalf of consumers for hearings and trials. Notice of Vacanies on the Clients' Security Board

The Justices of the Supreme Judicial Court invite applications for appointment to the Clients' Security Board. 
 
Two vacancies will occur on the Board in December, 2019, due to the expiration of the terms of incumbent members. Terms are for five years. Under S.J.C. Rule 4:04, the Board manages the fund used to discharge the bar's collective responsibility with respect to losses caused to the public by defalcations of members of the bar. The Court is seeking lawyers with experience in trusts and estates, personal injury law, and civil litigation. An interest in professional responsibility is desirable but not essential.
